Please read these terms carefully before using our facilities and services

1. Introduction

Welcome to Eden Social Club. These Terms of Service govern your access to and use of all services, facilities, programmes, and offerings provided by Eden Social Club, located at 1F-10, KLGCC Mall, Bukit Kiara, 60000 Kuala Lumpur, Malaysia.

By accessing our premises, purchasing a membership, booking a class or treatment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using our facilities and services.

Eden Social Club reserves the right to update or modify these Terms of Service at any time. We will notify members of material changes via email or through our booking platform. Your continued use of our services following any changes constitutes acceptance of the updated terms.

2. Definitions

Throughout these Terms of Service, the following definitions apply:

  • "Eden", "we", "us", or "our" refers to Eden Social Club and its owners, operators, employees, and authorised representatives.
  • "Member" refers to any individual who holds an active membership or has purchased a class pack.
  • "Guest" or "User" refers to any person who accesses or uses our facilities or services, whether or not they hold a membership.
  • "Services" includes all fitness classes, beauty treatments, recovery suite sessions, cafe offerings, and any other programmes or activities provided by Eden Social Club.
  • "Booking Platform" refers to the Momence platform through which class bookings, memberships, and payments are managed.

3. Membership Terms

3.1 Membership Plans

Eden Social Club offers various membership plans, including the Founder's Circle membership at RM299 per month and individual class packs. The specific benefits, pricing, and terms of each membership plan are outlined at the time of purchase and may be subject to change with prior notice to existing members.

3.2 Eligibility

Membership is available to individuals aged 18 years and above. Members under 18 must have written consent from a parent or legal guardian, who shall also agree to these Terms of Service on their behalf. Eden Social Club reserves the right to request proof of age at any time.

3.3 Membership Duration and Renewal

Monthly memberships are billed on a recurring basis and will automatically renew at the end of each billing cycle unless cancelled. Class packs are valid for the period specified at the time of purchase and do not automatically renew. Unused classes in a class pack will expire at the end of the validity period and are non-transferable.

3.4 Membership Cancellation

Members may cancel their monthly membership at any time by providing written notice via email to hello@edensocialclub.com or through the Momence platform. Cancellation requests must be submitted at least 7 days before the next billing date to avoid being charged for the following period. The membership will remain active until the end of the current paid billing cycle.

3.5 Membership Suspension and Freeze

Members may request a temporary freeze of their membership for a minimum of one month and a maximum of three months per calendar year, subject to approval. Freeze requests must be submitted in writing at least 7 days before the next billing date. A reduced administrative fee may apply during the freeze period. 3.6 Termination by Eden Social Club

Eden Social Club reserves the right to suspend or terminate any membership without refund if a member violates these Terms of Service, engages in conduct that is harmful to other members, staff, or the reputation of Eden Social Club, or fails to make timely payments.

4. Class Booking and Cancellation Policy

4.1 Bookings

All fitness class and recovery suite bookings must be made through the Momence booking platform. Bookings are confirmed upon successful payment or deduction from an existing class pack or membership allocation. Walk-in availability is subject to capacity and cannot be guaranteed.

4.2 Cancellation Window

You may cancel or reschedule a booked class free of charge up to 12 hours before the scheduled start time. Cancellations made within 12 hours of the class start time will result in forfeiture of the class credit or session fee. No refund or credit will be issued for late cancellations.

4.3 No-Shows

Failure to attend a booked class without prior cancellation constitutes a no-show. No-show sessions will be deducted from your class pack or membership allocation and are non-refundable. Repeated no-shows may result in temporary restrictions on your ability to book future classes.

4.4 Waitlist

When a class reaches full capacity, you may join the waitlist through the Momence platform. If a spot becomes available, you will be automatically enrolled and notified. If you are added from the waitlist and cannot attend, standard cancellation and no-show policies apply.

4.5 Class Schedule Changes

Eden Social Club reserves the right to modify the class schedule, substitute instructors, or cancel classes due to unforeseen circumstances, including but not limited to instructor illness, insufficient enrolment, or facility maintenance. In the event of a class cancellation by Eden Social Club, affected members will be notified and a full credit or refund will be issued.

4.6 Punctuality

We kindly ask that you arrive at least 10 minutes before your scheduled class time to allow for check-in and preparation. Latecomers may be denied entry to the class for safety reasons, particularly for Lagree fitness sessions where proper warm-up and equipment orientation are essential. Late arrivals that are denied entry will be treated as no-shows.

5. Beauty Treatment Bookings

5.1 Appointment Bookings

Beauty treatment appointments, including lash extensions, brow services, and dry bar sessions, may be booked through the Momence platform, by phone at +60 12-958 9069, or by email. A deposit may be required at the time of booking for certain premium services.

5.2 Cancellation of Beauty Appointments

Beauty treatment appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled appointment time. Cancellations made within 24 hours will result in forfeiture of any deposit paid, or a late cancellation fee equivalent to 50% of the service price may be charged. No-shows for beauty appointments will be charged the full service fee.

5.3 Consultation and Patch Tests

Certain beauty treatments may require a consultation or patch test prior to the appointment. Eden Social Club reserves the right to refuse service if a required consultation or patch test has not been completed, or if a client presents with a condition that contraindicates the treatment. In such cases, a full refund will be provided.

6. Payment Terms

6.1 Accepted Payment Methods

We accept payment via credit card, debit card, online bank transfer, and e-wallets through our Momence booking platform. Cash payments may be accepted at the premises for cafe purchases and select services. All prices are quoted in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless otherwise stated.

6.2 Automatic Billing

By subscribing to a monthly membership, you authorise Eden Social Club to charge the payment method on file on a recurring basis at the agreed-upon membership fee. You are responsible for ensuring that your payment information is accurate and up to date. Failed payment attempts will be retried, and continued payment failures may result in suspension of membership benefits.

6.3 Price Changes

Eden Social Club reserves the right to adjust pricing for memberships, class packs, and services at any time. Current members will be given at least 30 days' written notice before any price increase takes effect on their membership. New pricing will not apply to pre-purchased class packs for their remaining validity period.

7. Refund Policy

7.1 General Refund Policy

All purchases, including memberships and class packs, are generally non-refundable except as expressly stated in these terms or as required by applicable Malaysian law. Refund requests must be submitted in writing to hello@edensocialclub.com and will be reviewed on a case-by-case basis.

7.2 Membership Refunds

Monthly membership fees are non-refundable once a billing cycle has commenced. If you cancel your membership, you will continue to have access to membership benefits until the end of your current paid period. No pro-rata refunds will be issued for partial months.

7.3 Class Pack Refunds

Class packs are non-refundable once purchased. In exceptional circumstances, such as a verified medical condition that prevents participation for the remainder of the validity period, Eden Social Club may, at its sole discretion, issue a partial credit or extend the validity period. Supporting documentation will be required.

7.4 Service Cancellation by Eden

If Eden Social Club cancels a class, treatment, or service, a full credit or refund will be provided to the affected member. Refunds will be processed to the original payment method within 14 business days.

8. Health Disclaimers and Safety

8.1 Medical Clearance

You should consult your physician or healthcare provider before commencing any fitness programme, including Lagree fitness classes, recovery suite sessions (infrared sauna, cold plunge), or any other physical activity offered at Eden Social Club. By participating in any fitness class or recovery session, you confirm that you are in good physical health and have no medical condition that would be aggravated by physical exercise or thermal therapy.

8.2 Pre-Existing Conditions

You are responsible for disclosing any pre-existing medical conditions, injuries, allergies, or pregnancies to our staff and instructors before participating in any class, treatment, or service. This includes but is not limited to cardiovascular conditions, musculoskeletal injuries, skin sensitivities, and any conditions that may be affected by heat therapy (for infrared sauna) or cold exposure (for cold plunge).

8.3 Recovery Suite Advisory

The infrared sauna and cold plunge facilities carry inherent risks. Use of the recovery suite is not recommended for individuals who are pregnant, have cardiovascular conditions, suffer from blood pressure irregularities, have open wounds, or have any other condition that may be adversely affected by extreme temperatures. You use these facilities entirely at your own risk and must follow all posted guidelines and staff instructions.

8.4 Beauty Treatment Advisory

Certain beauty treatments, including lash extensions and brow services, may cause allergic reactions in some individuals. You are responsible for informing our staff of any known allergies or sensitivities prior to treatment. Eden Social Club is not liable for reactions arising from undisclosed allergies or failure to follow aftercare instructions.

8.5 Cafe and Nutritional Services

Our cafe offerings are prepared with care, however we cannot guarantee a completely allergen-free environment. If you have food allergies or dietary restrictions, please inform our cafe staff before placing an order. Nutritional information provided is approximate and should not be used as a substitute for professional dietary advice.

9. Assumption of Risk and Liability Waiver

9.1 Assumption of Risk

By participating in any fitness class, using the recovery suite, or engaging in any physical activity at Eden Social Club, you acknowledge and accept the inherent risks associated with such activities. These risks include, but are not limited to, physical injury, muscle strain, sprains, fractures, burns from thermal therapy, cardiovascular events, and in rare cases, serious injury or death.

9.2 Limitation of Liability

To the fullest extent permitted by Malaysian law, Eden Social Club, its owners, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of our facilities, services, or equipment, including but not limited to personal injury, property damage, or loss of personal belongings.

9.3 Waiver and Release

By using our services, you hereby release, waive, and discharge Eden Social Club from any and all claims, demands, actions, or causes of action arising from or related to any loss, damage, or injury that may be sustained during your use of our facilities or participation in our services, to the extent permitted by applicable law. This waiver does not apply to liability arising from gross negligence or wilful misconduct on the part of Eden Social Club.

9.4 Personal Property

Eden Social Club is not responsible for any loss, theft, or damage to personal property brought onto the premises. Members and guests are advised not to leave valuables unattended. While lockers may be available, Eden Social Club does not accept liability for items stored in lockers or left on the premises.

10. User Conduct

10.1 General Conduct

All members and guests are expected to conduct themselves in a respectful, courteous, and considerate manner at all times while on Eden Social Club premises. We are committed to maintaining a welcoming and inclusive environment for all.

10.2 Prohibited Conduct

The following conduct is strictly prohibited:

  • Harassment, intimidation, or discrimination of any kind towards other members, guests, or staff.
  • Use of offensive, abusive, or threatening language or behaviour.
  • Attendance at classes or use of facilities while under the influence of alcohol or illicit substances.
  • Smoking or vaping anywhere on the premises.
  • Photography or video recording in the studio, treatment rooms, or recovery suite without prior written consent from Eden Social Club and all individuals present.
  • Bringing outside food or beverages into the studio or treatment areas.
  • Using equipment in a manner inconsistent with instructions provided by staff or instructors.
  • Soliciting or promoting external products or services on the premises without authorisation.

10.3 Hygiene and Dress Code

Members and guests must wear appropriate athletic attire for fitness classes, including closed-toe athletic shoes where required. Grip socks are mandatory for Lagree classes and are available for purchase at Eden Social Club. Towels should be used on all shared equipment, and we ask that you wipe down equipment after use.

10.4 Consequences of Misconduct

Eden Social Club reserves the right to refuse entry, remove any individual from the premises, or suspend or terminate a membership without refund in the event of a violation of these conduct standards. Such actions are at the sole discretion of Eden Social Club management.

11. Intellectual Property

11.1 Ownership

All content, materials, branding, trademarks, logos, class names, programme names, website content, and other intellectual property associated with Eden Social Club are the exclusive property of Eden Social Club or its licensors. This includes but is not limited to the Eden Social Club name, logo, website design, marketing materials, class formats, and training methodologies.

11.2 Restrictions

You may not reproduce, distribute, modify, display, perform, or otherwise use any of Eden Social Club's intellectual property without prior written consent. Unauthorised use of our trademarks, trade names, or copyrighted materials may result in legal action.

11.3 User-Generated Content

By sharing content related to Eden Social Club on social media or other platforms and tagging or mentioning Eden Social Club, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content for marketing and promotional purposes. You retain ownership of your original content.

12. Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Service. By using our services, you consent to the collection and use of your personal information as described in our Privacy Policy, in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA).

13. Indemnification

You agree to indemnify, defend, and hold harmless Eden Social Club, its owners, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of our facilities and services, your violation of these Terms of Service, your violation of any rights of a third party, or any injury or harm caused by your actions or omissions while on our premises.

14. Force Majeure

Eden Social Club shall not be liable for any failure or delay in performing its obligations under these Terms of Service if such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government orders, power failures, equipment breakdowns, strikes, or other events of force majeure. In such circumstances, Eden Social Club will make reasonable efforts to notify affected members and provide credits or alternative arrangements where possible.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Malaysia. Any legal proceedings arising from or related to these Terms of Service or your use of Eden Social Club's services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

16. Dispute Resolution

16.1 Informal Resolution

In the event of any dispute, claim, or controversy arising from or related to these Terms of Service or your use of our services, we encourage you to contact us first at hello@edensocialclub.com to attempt an informal resolution. We are committed to resolving disputes amicably and in good faith.

16.2 Mediation

If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia. The mediation shall be conducted in the English language and the costs of mediation shall be shared equally between the parties unless otherwise agreed.

16.3 Arbitration

If the dispute remains unresolved after mediation, it shall be referred to and finally resolved by arbitration administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia, in accordance with its arbitration rules. The arbitration shall be conducted in the English language, and the decision of the arbitrator shall be final and binding on both parties.

17. Severability

If any provision of these Terms of Service is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms of Service, together with the Privacy Policy and any additional terms and conditions agreed upon at the time of purchase or enrolment, constitute the entire agreement between you and Eden Social Club regarding the use of our facilities and services. These terms supersede all prior agreements, representations, and understandings, whether written or oral.
